WAIVER

WAIVER AND RELEASE: Disc Golf presence on property.

By entering this property, 26216 SW Mountain Road, West Linn, OR, 97068, In consideration of being allowed to participate at the private Disc Golf Course, “Hyzer Hill Disc Golf Course” on the property of Adam Boeckman and Melissa Ives, Hyzer Hill DGC LLC, (the Release) and any and all related events and activities, I agree to the following;

1. I acknowledge and fully understand that my participation in disc golf or other activities may involve the risk of injury, including the possibility of serious injury or death, not only from my own actions, but also from the action or inaction of others, the condition of the premises, or the failure of the equipment used. I knowingly agree to assume all such risks, known and unknown, and assume full responsibility for my participation. This also applies if I consume alcohol, marijuana or other drugs on the property and then after leaving the property, cause death or injury due to my fault through being impaired as a result, I agree to not hold the owners, staff and representatives of property or Hyzer Hill DGC LLC liable due to my own actions while here or after leaving here.

2. I agree to conduct myself during my presence on the property, Adam Boeckman Private Residence, located at 26216 SW Mountain Road, West Linn, OR 97068, with all due regard for my own safety and the safety of all participants, observers and bystanders. I agree to comply with the directions of owners of the property, and I agree to immediately notify owners, organizers or property workers, if I observe any unsafe condition or behavior during my time on the property as above.

3. For myself, and on behalf of all of my heirs, assigns, executors, personal representatives and next of kin, I hereby waive and forever release the owners of the property and/or Hyzer Hill DGC LLC, Adam Boeckman and Melissa Ives’ private residence or Hyzer Hill Disc Golf Course worker agents from and against any and all liabilities, claims, expenses or causes of action of any kind or nature whatsoever, arising out of or relating to my participation or presence on the property as stated above.

4. Further, I understand and acknowledge that there currently exists a global pandemic associated with the disease COVID-19, that I am participating in this event at my own risk, that any safety precautions designed to protect against the spread of COVID-19 undertaken by the Release does not guarantee I will not contract COVID-19, and that, the foregoing notwithstanding, it is my specific intent to affirm my foregoing release of the Release with respect to any personal injury, loss, damage to property, or death I may experience from COVID-19 in connection with my participation in this event.

5. Hyzer Hill Disc Golf Course reserves the right to refuse play or players for any reason, at any time. 

I have read this waiver and release agreement and fully understand its terms. I understand that I have given up substantial rights when my request for membership to the Hyzer Hill Disc Golf Course  player group is approved allowing me to enter the property and play and I agree to accept/agree to this waiver, by proceeding forward from this notice.

I also recognize that the Hyzer Hill Disc Golf Course, Hyzer Hill DGC LLC and the EVENT organizers have the right and responsibility to record video and still photography of any and all participants. I hereby grant permission that such photography may be used for event publicity, public information, or any other promotional use that falls within the host activity.
